On January 31, 2020, the U.S. Department of Health and Human Services (HHS) issued a Declaration of Public Health Emergency in connection with the new 2019 Coronavirus, the source of an outbreak of respiratory illness that was first detected in the Hubei province in China.  Due to the very serious nature of the condition, and the detection of several cases in the U.S. in individuals who had recently traveled to the affected Chinese province, the U.S. government has issued the following travel restrictions:

Travel Ban Expands to Additional Countries

On January 31, 2020, President Trump issued a new Presidential Proclamation that expands the previous travel ban (Travel Ban 3.0) to include Burma (Myanmar), Eritrea, Kyrgyzstan, Nigeria, Sudan, and Tanzania, as related to nationals of those countries who are seeking immigrant visas (as opposed to non-immigrant visas).  The new travel ban (Travel Ban 3.0) is expected to take effect on February 21, 2020.

New Year, New I-9 Version

On January 31, 2020, the U.S. Department of Homeland Security officially rolled out the new version of Form I-9 Employment Eligibility Verification.  The new form version (edition 10/21/19)  has replaced the prior version (edition 07/17/17), and is available on the U.S. Citizenship and Immigration (USCIS) website at The 10/21/19 edition will become mandatory as of April 30, 2020.  Up until that date, employers may use either the 10/21/19 or the 07/17/17 edition.

2020 H-1B Lottery Will Take Place Early Based on New Filing Rules

The U.S. Citizenship and Immigration Services (USCIS) recently announced that it has finished testing the pilot H-1B registration process for the upcoming H-1B work visa season.  Historically, the H-1B visa lottery would take place the second week of April, after the H-1B filing season would open on April 1st.  Under the new H-1B registration system, the lottery is expected to take place during the second half of March.

Expired Form I-9 Still in Use Until Further Notice From USCIS

The most recent version of Form I-9 Employment Eligibility Verification has an expiration date of August 31, 2019. A new I-9 form version is in the works, but USCIS has not yet finalized or released it for use by employers. Until USCIS publishes the new Form I-9 version, employers must continue to timely and properly complete Form I-9 for all new hires by using the existing I-9 version (showing an issue date of 07/17/17 at the bottom and a 08/31/2019 expiration date at the top).
